Expert Witness Services

Supporting service users with any form of risk behaviour imposes a duty of care upon care and education sector employers to develop a safe system of work and safe ways of working. In the event however of injury and/or allegations regarding the infringement of the rights of staff or service users, individuals may seek redress under civil law. In the most serious of cases where death occurs charges of corporate man slaughter can arise leaving senior managers personally exposed to imprisonment.

Ultimately the crux of any defence if a duty of care is admitted or established, is that the actions of the employing organisation or its agents were “Reasonable” and complied with the prevailing practice standards. Whilst full conformance with the CALM and BILD quality assurance arrangements will constitute a major protection from liability, CALM Training can also provide expert witness services to both organisations and individuals.

Two of our Directors are recognised international experts in the fields of behavioural management and restraint safety. In addition they have often had direct involvement in the development of the relevant national standards and guidance, which are used in legal proceedings to frame judgements of “reasonableness” action. Both Directors regularly act as expert witnesses and have completed over fifty reports in both English and Scottish cases.

The commissioning of an expert witness report can also provide agencies with an independent analysis of the potential defensibility of their position should a serious adverse event occur at some point in the future. Such advice prior to any such event can enable preventative measures to be taken sometimes for minimal cost and offers the commissioning organisation reassurance that should an adverse event occur it has done all that was reasonably practicable to prevent it.
